Who you are contracting with
Tend is operated by [LEGAL ENTITY NAME] ("Tend", "we", "us"). By creating an account or continuing to use the service, you agree to these terms.
The service
Tend helps ministry leaders remember conversations and follow up with people. You write notes; Tend organizes them by person and household and suggests follow-ups. Suggestions are only suggestions — nothing is sent automatically, and you are responsible for every message you choose to send.
You must be of legal age in your jurisdiction, or have authority to bind your organization, to use Tend.
Your account
Keep your login credentials confidential. You are responsible for all activity under your account and for providing accurate information and keeping it up to date.
Acceptable use
You must not misuse the service, including:
- using it for anything unlawful, fraudulent, or to send spam;
- infringing anyone's intellectual property or privacy rights;
- interfering with the service's security, including malware, probing, or scraping;
- reverse engineering, reselling, or redistributing the service;
- circumventing technical limits, such as plan limits on people.
You are responsible for the notes and content you enter, for having the right to record it, and for how you use the follow-ups Tend suggests. Tend does not diagnose, score, or make decisions about people — those judgments are yours.
Intellectual property
We own the service and its intellectual property, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.
Your notes remain yours. You grant us a limited license to host and process your content solely to provide the service.
Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Paid plans renew automatically until cancelled; you can cancel at any time from the billing page, and your access continues until the end of the paid period.
Service level
We work hard to keep Tend reliable, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability is capped at the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated and serious violations. When your account ends, you may request an export of your data within 30 days; after that, it is deleted.
General
These terms are governed by the laws of the State of [STATE], and disputes will be heard in the courts of [STATE]. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control. If part of these terms is unenforceable, the rest remains in effect.
